Trump and 18 co-conspirators are now charged with racketeering, forgery, impersonating a public officer, false statements and writings, seeking to have public officials violate their oaths of office, filing false statements, influencing witnesses, conspiracy to commit election fraud, breaking into local election computers, lying to investigators, and perjury. The defendants seeking to overturn a free and fair election by illegal means include: Donald Trump, Rudy Giuliani, John Eastman, Mark Meadows, Ken Chesebro, Jeffrey Clark, Jenna Ellis, Sidney Powell, and others from the Trump campaign, the Georgia bar and state GOP leadership. These are well-educated, experienced, and highly trained individuals who knew better. Their conspiracy to overthrow the results of the Presidential election included many other states where Trump had also lost such as Arizona, Michigan, and Pennsylvania in addition to Georgia.

 

The alleged operative facts are: they made false statements to state legislators, the Governor, the Secretary of State, the Speaker of the House of Representatives, the leader of the Senate to get them to overturn Trump’s loss in Georgia. They forged and filed fake election documents purporting to appoint a set of Trump supporting electors from Georgia. They tried to get a letter from the federal Department of Justice falsely saying there had been massive electoral fraud in Georgia (and elsewhere) and the state legislature and Governor should reject the election results and elect Trump. They tried to get Vice President Mike Pence to single-handedly throw out Joe Biden’s victory in Georgia and to throw the Presidential election to Trump. They tried to intimidate and harass Ruby Freeman, an election worker from Fulton County, to change her testimony. They secured unauthorized access to the voting machines, the software, the ballots, and voters’ personal information in Coffee County, GA. They lied about and sought to cover up their conduct to state and local investigators, including under oath before the Grand Jury.

 

The elected GOP officials in Georgia including Governor Kemp and Secretary of State Raffensberger foiled their efforts by refusing to violate their oaths of office to reverse Biden’s victory and Trump’s loss. Vice President Pence refused to go along with their unconstitutional schemes to overthrow the certified election results. The Trump-appointed top leadership at the Department of Justice and the staff of the Georgia Secretary of State investigated the Trump campaign’s complaints, determined they were not meritorious, and refused to enable Trump’s efforts to overthrow the election results in Georgia. District Attorney Willis conducted a careful and thorough, two and a half years investigation with full grand jury consideration and recommendations before bringing any criminal charges. I think the nation owes her and her staff an enormous debt of gratitude for the care, dedication and persistence they have shown in a most difficult task,

Trump and his alleged 18 co-conspirators are entitled to a presumption of innocence, and a fair trial before an impartial jury. They must be proven guilty beyond a reasonable doubt by a unanimous 12 person jury. These are high bars before they can be convicted for their alleged criminal conduct. This trial in Atlanta brought by DA Willis and the DC trial of Trump brought by the Special Council Smith are the most important moments of our lives.
